FIVE PEAS™ (ABN 48 166 823 169) is a business name and trade mark owned by SHAVE PRODUCTIONS PTY LIMITED (ACN 166 823 169) operating at offices situated at 238A Riley Street, SURRY HILLS NSW 2010 in the business of production of live broadcasts, events and short-form branded content and owner of the website fivepeas.com.au, ("Services and Operations").

B. SCOPE OF THIS PRIVACY POLICY

1. This Privacy Policy applies to our Services and Operations and all individuals who access our Services and Operations.

2. We are committed to:

a) protecting the privacy of everyone who accesses or uses our Services and Operations,

b) for them to understand what Personal Information we collect and store,

c) why we do so,

d) how we receive and/or obtain that information,

e) the rights an individual has with respect to their Personal Information in our possession, and

f) with complying with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) (Privacy Act).

b) whether the information or opinion is recorded in a material form or not" 1.1 Therefore Personal Information includes not just name and address but also things like job references, recommendations about individuals and expressions of opinion about individuals that may arise and be stored via correspondence, recorded messages, video recordings or on-line. 1

2. Where information is made anonymous such as when it is collated for statistical purposes and the identification address and any other identifying details are removed it is not Personal Information.

b) Investigating any complaints about or made by an individual, or if we have reason to suspect that an individual is in breach of any of our terms and conditions or that an individual is or has been otherwise engaged in any unlawful activity; and/or

d) for purposes of sale of the Operations or Services and hand over of personal information;

3. We use Dropbox, Google Docs, Gmail and Vimeo and may use other third party cloud services from time to time whereby data that may include Personal Information is stored overseas.

H. OPTING IN OR OUT OF NEWSLETTERS AND MARKETING INFORMATION

1. We may, from time to time, send you newsletters, invitations to receive marketing information. You can opt out of receiving further such communications by notifying us using our contact details below by clicking the "unsubscribe" option at the bottom of any marketing e-mail received from us.

The third party cloud services we use all have secure encrypted servers.

1. You can contact us to access, correct or update your personal information.

Unless we are subject to confidentiality obligation or some other restriction on giving access to the information and we are permitted to refuse you access under the Privacy Act, we will endeavour to make your information available to you within 30 days.

Examples of circumstances where we may refuse to give you access to your personal information include where:

a) giving access would be unlawful;

b) we reasonably believe that giving you access would pose a serious threat to the life, health or safety of any individual or to public health or public safety;

c) giving access would have an unreasonable impact on the privacy of others;

K. COMPLAINTS AND DISPUTES

2. If we have a dispute regarding an individual’s Personal Information, we both must first attempt to resolve the issue directly between us failing which we will refer the dispute for mediation through the Australian Commercial Disputes Centre.

3. If we become aware of any unauthorised access to an individual’s Personal Information we will inform them at the earliest practical opportunity once we have established what was accessed and how it was accessed.

L. NOTIFICATION OF CHANGES

If we decide to change our Privacy Policy, we will post a copy on our website.
